This License is between you and R8VEN LLC (“we”, “us”), 30 N Gould St, Ste R, Sheridan, WY 82801, United States. It governs your use of the Kandedong Reader, Dictionary, Flashcards and Browser Extension, the KDD Dictionary, and the related content and data (the “Software”). It works together with our Terms of Service and Privacy Policy.
1. License grant
If you follow this License and pay any fee that applies, we give you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to use the Software for your own personal, non-commercial reading and language learning, according to your plan:
- Free tier: the features marked free, for as long as we offer them.
- Pro: the Pro features, for as long as your subscription is active.
- Perpetual: a perpetual license to the version 2 line of the Software and to the KDD Dictionary version 2 content, including version 2 updates. It does not include a future major version, such as version 3, unless we say so in writing.
This is a license, not a sale. We and our licensors keep all rights in the Software.
2. The KDD Dictionary and proprietary content
The KDD Dictionary (its entries, definitions, categories, examples, translations, structure and compilation) is our original work and is protected by copyright and other laws. You may view and use it personally inside the Software while your plan includes it. You may not extract, export in bulk, copy, scrape, redistribute, sublicense, sell or publish the KDD Dictionary or a substantial part of it outside the Software, or use it to build, train or improve a competing product, dataset, model or service.
3. Free dictionaries and open licenses
Some free-tier dictionary data comes from CC-CEDICT, licensed under Creative Commons Attribution-ShareAlike 4.0 (CC BY-SA 4.0). Our CC-CEDICT-derived dictionaries are available under the same license, and this License does not restrict your rights in that material. That license applies only to those free dictionaries, not to the KDD Dictionary or the Software. Other third-party parts, such as the PDF engine, OCR models and pinyin and stroke data, have their own licenses, which this License does not replace.
The Kandedong website uses the 3D model “Headphones” by Michael Fuchs (poly.pizza), licensed under Creative Commons Attribution 3.0 (CC BY 3.0).
4. Restrictions
You may not, and may not let anyone else:
- copy, modify, translate or make derivative works of the Software, except where this License or an open license allows it;
- reverse engineer, decompile or disassemble the Software, except where the law does not allow this to be prohibited;
- remove or hide any copyright, trademark or other notice;
- rent, lease, lend, sell, sublicense or distribute the Software or the KDD Dictionary, or offer them as a service to others;
- use bots, scrapers or crawlers to extract data or content;
- get around any license, entitlement, security or usage limit, or use the Software without a valid plan;
- use the Software to build a competing product or service.
5. Updates
We can provide updates, and this License covers them unless an update has its own terms. We are not obliged to provide updates or support, except as the Perpetual plan or the Terms of Service state.
6. Term and termination
This License is in effect until it ends. It ends automatically if you breach it. When it ends, stop using the Software and delete local copies that you control. Sections 2, 4, 7, 8 and 9 survive.
7. Disclaimer of warranties
The Software is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. Definitions, OCR output, pinyin and translations can contain errors and are for learning only.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100.
9. General
This License is governed by the laws of the State of Wyoming, United States. Disputes are subject to the dispute resolution terms in Section 19 of the Terms of Service, including the arbitration agreement and the class-action waiver. If a provision cannot be enforced, the rest stays in effect. We can update this License as described in the Terms of Service.
